AJC, LLC d/b/a Core Change (“Core Change”) is committed to protecting your privacy.  This Statement of Privacy applies to your use of Core Change services and the Core Change app powered by Mariana Tek and governs data collection and usage under both.  By using Core Change’s services or app, you consent to the data practices described in this statement.

Collection of Your Personal Information

Core Change collects personally identifiable information including, but not limited to, your e-mail address, name, home or work address, telephone number, billing information, age, date of birth, gender, height, weight, heart rate and other health metrics, dietary habits, sleep habits, exercise routines, injuries and medical conditions, and other health and lifestyle data.

There is also information about your computer or cell phone hardware and software that is automatically collected by Core Change when you use the Core Change app.  This information may include: your IP address, browser type, domain names, access times and referring website addresses.  This information is used by Core Change for the operation of the app, to maintain the quality of the app, and to provide general statistics regarding use of the Core Change app.

Core Change encourages you to review the privacy statements of websites and apps you choose to link to from the Core Change app so that you can understand how those websites and apps collect, use and share your information.  Core Change is not responsible for the privacy statements or other content on websites and apps outside of the Core Change app.

Use of Your Personal Information

Core Change collects and uses your personal information to operate the Core Change app and deliver the services you have requested.  Core Change also uses your personally identifiable information to inform you of other products or services available from Core Change and its affiliates.  Core Change may also contact you via email, phone or the app to conduct research about your opinion of current services or of potential new services that may be offered.

Core Change does not sell, rent or lease its customer lists to third parties.  Core Change may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you.  In those cases, your unique personally identifiable information (e-mail, name, address, telephone number, etc.) is not transferred to the third party.

Core Change keeps track of the websites, apps and pages our customers visit within the Core Change app, in order to determine what Core Change services are the most popular.  This data is used to deliver customized content and advertising within Core Change to customers whose behavior indicates that they are interested in a particular subject area.

Core Change will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to legal requirements or comply with legal process served on Core Change or the app; (b) protect and defend the rights or property of Core Change; and, (c) act under exigent circumstances to protect the personal safety of users of Core Change, or the public.

Use of Cookies

The Core Change app uses "cookies" to help you personalize your online experience.  A cookie is a text file that is placed on your hard disk by a web page or app server.  Cookies cannot be used to run programs or deliver viruses to your computer, phone, tablet or other device.  Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to provide a convenience feature to save you time.  The purpose of a cookie is to tell the web server that you have returned to a specific page, which simplifies the process of collecting your personal information.  When you return to the Core Change app, the information you previously provided can be retrieved, so you can easily use the features that you customized.  We also use cookies to assist in our marketing efforts, using information on the pages you’ve visited to occasionally surface ads, special offers, and other information of potential interest.

You have the ability to accept or decline cookies.  Most web browsers automatically accept cookies, but you can usually modify your browser or device settings to decline cookies if you prefer.  If you choose to decline cookies, you may not be able to fully experience the interactive features of the Core Change app.

Security of Your Personal Information

Core Change secures your personal information from unauthorized access, use or disclosure.  Core Change secures the personally identifiable information you provide on Mariana Tek owned computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure.  When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol.

User Rights

You have the right to request access to the personal information we hold about you.  You may contact Core Change at any time to receive a copy of the data we’ve collected.  If you believe the information we have about you is incorrect or incomplete, you have the right to request that we correct or update it.  You may also request that we delete your personal information at any time, subject to applicable legal obligations (such as retention for legal purposes).  To delete your account, please follow the instructions in the Core Change app or contact us for help.  Upon account deletion, we will delete your personal data from our systems, except for any data we are required to retain for legal purposes.

Other Legal Notices

Any dispute over privacy is subject to this Privacy Statement.  This Privacy Statement is governed by the laws of the State of Tennessee.  Core Change will occasionally update this Privacy Statement to reflect company and customer feedback.  Please note that the use of information that Core Change gathers is subject to the Privacy Statement in effect at the time of use.  You should check the Core Change app frequently to see recent changes.

Core Change Liability Waiver:

In exchange for permission to participate in Core Change classes and/or private sessions, I hereby enter into the following release and waiver of liability, assumption of risk and indemnity agreement and photo release. I, for myself, my heirs, spouse, executors, administrators, personal representatives and assignees, waive, release, discharge, defend, indemnify, hold harmless and agree not to sue Core Change, its owner, employees, contractors, managers, members, agents, landlords, representatives, volunteers, and affiliates (hereafter the “Released Parties”) from, any and all liability, responsibility, damages, losses, claims, demands, actions, suits, judgments, costs and expenses (including attorneys’ fees) resulting from personal injury, accidents, illnesses, death and/or property loss caused in any manner, including theft, fire and the simple, active or passive negligence of the Released Parties, by my participation in Core Change studio classes. I hereby understand that I am advised to move comfortably through the exercises and to work at my individual level of difficulty.

I acknowledge I have been advised to consult with my physician with respect to any past, present or future injury, illness, cardiovascular problem, knee problem, back problem, neck problem, osteoporosis, or any other condition that may affect my participation and ability to participate in and to endure the exercise programs, and knowingly assume all risks relating to my participation at Core Change.

I acknowledge that I have discussed with my physician the appropriateness of the classes offered by Core Change in connection with any illness or condition that I now have or have previously had and that I knowingly execute this agreement freely and voluntarily, and my acknowledgement is a complete and unconditional release of all liability to the greatest extent allowed by law.

I have read this agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. This agreement is intended to be as broad and inclusive as permitted by law. If any portion of this agreement is held invalid, the remaining portions will continue in full force and effect.

This agreement shall be construed and interpreted in accordance with the laws of Tennessee, without giving effect to its choice of law rules.  This agreement shall be binding upon and inure to the benefit of the parties hereto, their respective heirs, successors and assigns.  This agreement constitutes the entire agreement between the parties hereto and there are no representations, warranties, covenants or obligations except as set forth in this agreement.
